Careful market research can help the inventor evaluate their chances of success. For example, careful market research will help reveal:
  • how large the market for a product is
  • if the market is rapidly growing or slowly disappearing
  • what is the most appropriate selling price for a product
  • whether that selling price allows a profit to be made
  • what type of profit margin can be realized

Another aspect of evaluating whether the idea is worth pursuing involves determining the legal rights of the inventor. In other words, what types of protection can be obtained for the invention to ensure that others interested in the product idea will pay the inventor a royalty? Also, the inventor must determine if someone else already has rights to the product idea. Patent and Trademark searching is the best way for an inventor to find out if someone else has a patent which would prevent the inventor from pursuing the idea.

The first service we perform for our clients is to conduct market research for the product idea, and to engage a specialized law firm to conduct a legal protection evaluation, which includes performing patent and/or trademark searches. The results of these steps are provided to our client in a product profile which includes a marketability report prepared by our staff, and a legal protection report prepared by a registered patent and trademark attorney. Further information and recommendations will be provided to the client along with the legal and marketability reports.

Our product profile is directly tailored to the client's idea or concept. In addition, to ensure accuracy and completeness, all of our patent and trademark searches are performed at the United States Patent and Trademark Office in Arlington, Virginia. Many other companies perform local library or Internet searches, which do not produce reliable results.

While launching a new product is not an exact science, the avenues we pursue during our representation are those which we and other product development professionals believe to be the most effective way of making the idea successful. These steps include:

Preparing drawings which illustrate the invention. These drawings are utilized in a product brochure which will be described in further detail later. Even if the product/concept is just an idea, our drafting staff will produce realistic drawings which illustrate the invention, show its clever features, and demonstrate how it works.

Having a registered patent attorney seek patent and/or trademark protection for the idea by obtaining "patent pending" status for the invention, or establishing the client's "priority" in a trademark. A patent law firm will be hired on our client's behalf to seek whatever protection is mandated. We pay all legal fees associated with obtaining patent pending status or trademark protection. Remember, the law firm we engage is at out expense but at your service. You are welcome to contact the law firm directly regarding the progress of the services they are providing on your behalf.

Preparing a brochure which describes and illustrates the idea and its advantages. The brochure uses the drawings we have prepared. The drawings are accompanied by text which explains the invention and sells its praises.
